Mobile App Terms Of Service

1. Introduction
Welcome to Agora Markets, a micro market application operated by Agora Markets (“we,” “us,” or “our”). We are located at 21 Silicon Pl, Tullamarine, Australia. The app is exclusively available for use within Australia. By using or accessing our application, you agree to these Terms of Use (“Terms”). If you do not agree, please do not use our services.
2. Acceptance of Terms
These Terms govern your access and use of our services, including any content and functionality offered through the Agora Markets app. By creating an account, topping up your wallet, or otherwise using the app, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
3. Eligibility
You must be at least 18 years old to use the Agora Markets app. By using the app, you affirm that you are of legal age and capable of entering into a binding agreement.
4. Account Creation
When you create an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. If you discover any unauthorized use of your account, please notify us immediately.
5. Wallet and Top-Ups
The Agora Markets app serves as a digital wallet for purchasing products within our micro markets. To use the wallet, you must top it up with funds. Please note:
- Funds added to your wallet are non-refundable.
- You can only use the balance for purchasing products within our micro markets.
6. Agora Points
When you top up your wallet with certain amounts, you may receive Agora Points, which can be redeemed toward purchases. The points structure is as follows:
- Topping up with $20 grants 40 Agora Points.
- Topping up with $50 grants 150 Agora Points.
- Topping up with $100 grants 400 Agora Points.
- Topping up with $200 grants 1000 Agora Points.
Agora Points have no cash value and cannot be exchanged for a cash refund. We reserve the right to modify point values and the points system at any time.
7. Purchases and Refunds
All purchases made via the Agora Markets app will be deducted from your wallet balance or Agora Points (if you choose to redeem them). Since wallet top-ups are non-refundable, no refunds will be issued for unused balances. We reserve the right to correct any errors in pricing and to adjust prices at any time.
8. Location Tracking
The app may request access to your location only to determine the nearest micro market. Your location data is used solely for this purpose and is not stored or otherwise retained by us.
9. Barcode Scanning
The app may request access to your device’s camera to scan product barcodes. This functionality is used solely to facilitate product purchases, and we do not retain or store any images captured by your camera.
10. Intellectual Property
All content, features, and functionality (including but not limited to text, graphics, logos, and software) of the Agora Markets app are the exclusive property of Agora Markets or its licensors. You may not copy, reproduce, republish, transmit, distribute, or otherwise exploit any materials from our app without our prior written consent.
11. Limitation of Liability
To the fullest extent permitted by law, Agora Markets is not liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your use of the app. This includes damages for errors, omissions, interruptions, defects, or delays in operation or transmission.
12. Governing Law
These Terms are governed by the laws of Australia. Any disputes arising under or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Australia.
13. Changes to These Terms
We may update or modify these Terms at any time. Changes will be effective immediately upon posting within the app. Your continued use of the app following any changes indicates your acceptance of the revised Terms. We encourage you to periodically review these Terms for the latest information.
